Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and SwatiLabs LLP ("SwatiLabs", "we", "our", or "us") governing your access to and use of swatilabs.in and every product and service we build and operate under the SwatiLabs brand — including, for example, FieldOps365 (fieldops365.com) and ProSafeT (prosafet.in) — together with any product we launch in the future, whether or not it is named here (collectively, the "Services"). This is a single, umbrella set of Terms: unless a specific Service publishes additional terms for a use case unique to that Service (for example, product-specific pricing, refund, or subscription terms), these Terms govern it. By accessing or using any Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use any Service. If you use a Service on behalf of a business or organisation, you confirm you have the authority to bind that entity to these Terms.

2. Accounts

Where a Service requires an account:

• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You agree to provide accurate, current, and complete information during registration and to keep it updated.
• You must notify us promptly of any unauthorised use of your account.

3. Acceptable Use

When using any Service, you agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable regulation.
• Attempt to gain unauthorised access to any Service, account, or system.
• Reverse engineer, decompile, or attempt to extract the source code of a Service, except where permitted by law.
• Interfere with or disrupt the integrity or performance of a Service.
• Use a Service to send unsolicited communications, spam, or messages that violate WhatsApp's or any other messaging platform's policies.
• Upload or transmit any content that is unlawful, infringing, or harmful to others.

4. Payments, Subscriptions, and Orders

Where a Service involves payment — such as a ProSafeT order or a FieldOps365 subscription — the applicable pricing, billing cycle, and refund terms for that Service apply in addition to these Terms. Payments are processed by third-party payment processors; SwatiLabs does not store your full payment card details. Fees are exclusive of applicable taxes unless stated otherwise.

5. Communications

By using a Service, you consent to receive transactional and account-related communications from us — including over email, WhatsApp, and/or in-app notifications — as necessary to operate that Service (for example, job assignment or status updates, order confirmations, or one-time passwords). 6. Intellectual Property

All software, designs, text, graphics, logos, and other content that make up our Services are owned by SwatiLabs LLP or our licensors and are protected by applicable intellectual property laws. Except as expressly permitted by these Terms or a separate written agreement, you may not copy, modify, distribute, or create derivative works based on any Service.

7. Third-Party Services

Our Services may integrate with or rely on third-party platforms — such as Meta's WhatsApp Business Platform, payment processors, and shipping/logistics providers. Your use of those third-party components is also subject to their respective terms, and we are not responsible for the availability or conduct of third-party platforms outside our control.

8. Termination

We may suspend or terminate your access to a Service, in whole or in part, if you breach these Terms, if required by law, or where continued access would pose a security or operational risk. You may stop using a Service, or request account/data deletion, at any time — see our Data Deletion Instructions.

9. Disclaimers

Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that a Service will be uninterrupted, error-free, or completely secure.

10. Limitation of Liability

To the maximum extent permitted by applicable law, SwatiLabs LLP shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of a Service, even if advised of the possibility of such damages.

11. Indemnification

You agree to indemnify and hold harmless SwatiLabs LLP and its officers, employees, and partners from any claims, damages, or expenses arising out of your breach of these Terms or your misuse of a Service.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms or any Service shall be subject to the exclusive jurisdiction of the courts at Navi Mumbai, Maharashtra, India.

13. Changes to These Terms

We may update these Terms from time to time, including to reflect new SwatiLabs products as they launch. Material changes will be reflected in the "Last updated" date above, and continued use of a Service after such changes constitutes acceptance of the updated Terms.
